1. Acceptance of Terms

By accessing or using Quendell (“we,” “our,” or “us”), including our website, games, and related services (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

Quendell is open to players of all ages. Users aged 13 and older may create their own accounts. Children under 13 must play under a parent or guardian account. By creating an account, you represent that you are at least 13 years old, or that you are a parent or legal guardian creating an account on behalf of your child.

2. Description of Service

Quendell provides story-driven adventures and brain-training mini-games for casual gamers ages 5 and up. The Service includes:

• Free browser-based mini-games with adaptive difficulty
• A map-based adventure with zones, puzzle pieces, and clue discovery
• A 3D puzzle builder and decoration system
• Optional parent accounts for progress syncing and parental controls

3. Accounts

Users aged 13 and older may create their own accounts. For children under 13, a parent or legal guardian must create and manage the account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.

Child profiles are created by parents and do not require or collect any personal information from the child. See our Children's Privacy Notice for details.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or its servers
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) to access the Service
• Misrepresent your identity or age

5. Intellectual Property

All content on Quendell—including games, characters, artwork, music, stories, and software—is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, distribute, modify, or create derivative works from any part of the Service without our written permission.

6. User Data & Privacy

Your use of the Service is also governed by our Privacy Policy and Children's Privacy Notice (COPPA). We do not collect personal information from children. Game progress is stored anonymously and linked to parent accounts only.

7. In-App Economy

Quendell features an in-game currency called “Sparks” that can be earned through gameplay and used to acquire virtual items within the Service. Sparks and virtual items have no real-world monetary value, cannot be exchanged for real currency, and are non-transferable. We reserve the right to modify the Spark economy at any time.

8. Third-Party Services

The Service may use third-party providers for hosting (Vercel), authentication and data storage (Supabase), and payment processing (Stripe). Your use of these services is subject to their respective terms. We do not use third-party advertising or behavioral tracking.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

11. Account Termination

You may delete your account at any time from the Parent Dashboard. We may suspend or terminate accounts that violate these terms. Upon termination, your right to use the Service ceases and we may delete associated data.

12. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
